Should You Settle Or Go To Court?

Always go to court.  Unless there are some extenuating circumstances present, filing the lawsuit by a personal injury lawyer and going to court has a number of advantages.

Low Settlement Offers Early On

Many people may complain that the defendant’s early settlement offer is too low.  There are many reasons for why this may happen.  But, perhaps, the primary reason is that there is absolutely no pressure on the defense to settle the case at that time.  In addition, the defendant may prefer to pay a lawyer to defend the case rather than settle it early on in the hopes that discovery will turn up something negative about the plaintiff’s case.  Therefore, it is usually not ideal to settle a case early on unless it is clear that the defense attorney and his/her client are willing to reasonably negotiate a settlement at that point in time.

Jury Awards

Despite what may be said on television, juries routinely award high-dollar damages to plaintiffs – particularly if they find the defendant’s conduct egregious. Punitive damages can be awarded in cases where the defendant’s conduct was malicious or where the defendant acted in wanton and willful disregard of the plaintiff’s rights.

Higher Settlement Offers Right Before Trial

Many times, settlement offers are highest right before trial.  The defense usually has the highest incentive to settle the case right before trial, particularly if the plaintiff has put together a strong case during discovery by obtaining deposition testimony and expert opinion.  Occasionally, the defense will try to settle the case during jury deliberation.  At that point, however, it is usually apparent that the jury is going to come back with a high-dollar damages award.
